What the rule asks of a laboratory applicant
The same twelve records as a producer. The application section is written for "an applicant for a producer or laboratory permit": a business license in the state, Secretary of State and Taxation and Revenue registrations, a certificate of occupancy, proof of fire code compliance, electrical and HVAC inspection reports, proof of compliance with city and county planning and zoning, proof the facility is in New Mexico, proof of ownership or the owner's statement, conditional use permits where applicable, the in-state attestation, and whatever else the department reasonably requests. Each is walked in the producer pathway, and the agency that issues it does not ask which permit it is for: the business license, the facility, zoning, conditional use, and the drafter for the attestation and the owner's statement. 7.35.2.8 (A), p. 4
Plus one of two credentials. Either a license or permit from the Regulation and Licensing Department's Cannabis Control Division, with proof of current approval to operate as a cannabis testing laboratory in New Mexico, standard operating procedures for sampling and testing psilocybin, and an initial demonstration of capabilities for each test the rule requires; or current ISO/IEC 17025 or NELAC/TNI accreditation, with the same procedures and demonstration. 7.35.2.8 (C), p. 4
Not asked of a laboratory. The food safety training certificates for employees are a producer item only. 7.35.2.8 (B), p. 4
Once permitted. Test results are recorded in the traceability system, 7.35.2.15 (B), p. 8; the traceability account comes after the permit and its whole cost, including vendor fees, falls on the laboratory, 7.35.2.16 (A), (F), p. 8; the tests and their action levels are at 7.35.2.18 and 7.35.2.19, and the additional services a laboratory may offer at 7.35.2.20, p. 13. The traceability cost is unknown; see the producer application page.
